Does Your Deed Match Your Life Today?

Most homeowners don’t think about their deed until they are preparing to sell or refinance—and that’s often when an outdated detail becomes an unwelcome surprise.

Start with the recorded deed from the Maricopa County Recorder. A mortgage statement, tax bill or assessor’s record is not a substitute. Check the owners’ names, legal description and how ownership is listed.

Then consider what has changed since it was recorded. Has there been a marriage, divorce, death, name change or new trust? A deed may have been correct when you purchased your Gilbert home but no longer matches your life today.

Creating a trust does not automatically transfer your home into it. If your estate plan says the trust should own the property, confirm that the recorded deed reflects that. The deed should also be consistent with your mortgage and homeowners insurance.

If something appears incorrect, it is easier to address while everyone involved is available to cooperate. After any correction, verify that it was recorded. The goal isn’t to look for trouble—it’s to make sure the public record matches reality before a sale, refinance or major life event.
